What to Do After an Accident in Georgia
The first 48 hours shape the rest of your claim.
See a doctor the same day, even if you feel fine. Whiplash, internal injuries, and traumatic brain injuries frequently show no symptoms for days — and a gap between the crash and your first treatment is the first thing an insurance adjuster will point to when they argue your injuries came from something else. Getting checked out protects your health and your claim at the same time.
Report the crash before you leave the scene. Georgia requires a report for any accident involving injury, death, or apparent property damage of $500 or more, and you will need that incident number later. While you wait, photograph everything before it is moved: vehicle positions, skid marks, traffic signals, weather and road conditions, and your visible injuries. Evidence at a crash scene disappears within hours, and no one is going to preserve it for you.
Be careful with the other driver’s insurance company. You are not required to give them a recorded statement, and what you say in one is used to build the argument that you share the blame — which matters enormously in Georgia, where being found 50% or more at fault means you recover nothing at all. Early settlement offers work the same way. They arrive before anyone knows the full cost of your treatment, and once you accept one, it is final.

Generally, you have only 2 years from the date of the accident to file a personal injury lawsuit in Georgia, but the deadline might be shortened if the case involves a government entity or employee. Missing the deadline could mean losing your right to compensation permanently.
